From September 30th to October 1st 2010 at the invitation of the Czech Office for Personal Data Protection experts from the Bulgarian Commission for Personal Data Protection visited the Czech Republic. The subject of the talks was the Czech experience with the law enforcement authorities and the inspections of the protection of personal data processed by them. Czech representatives provided information on the organization and structure of the Czech supervisor of data protection, the Czech Republic`s accession to the Schengen area, rights of data subjects, data access to the National part of Schengen Information System and International Cooperation realized pursuant to Art. 114 (2) of the Schengen Convention. The powers of the Czech supervisory authority under the Law on Protection of Personal Data and other special laws relating to processing of personal data in certain areas were clarified.
Special attention was paid to the inspections of personal data processing by data controllers in the law enforcement. Theoretical information on the control activities and methodology of the inspections of the Czech Office for Personal Data Protection were presented as well as specific case studies of Czech inspectors incl. legal practice in connection with the appeal documents.
An emphasis was placed on the types of Schengen inspections and the role of national supervisors and the general supervisory authority under Schengen. In addition to discussing the Czech experience in the Schengen Information System and inspecting the law enforcement bodies, the meeting was a good occasion to discuss a number of other issues of current work of the two supervisory authorities
