In the context of the upcoming European elections at the end of May, the Central Electoral Commission and the Commission for Personal Data Protection jointly adopted guidelines on the processing and protection of personal data in the election process. The document is based on the provisions laid down in Regulation (EU) 2016/679, the Commission Guidance on the application of Union data protection law in the election context and the practice of the Central Electoral Commission and the Commission for Personal Data Protection. It has to be taken into account that during the election process, as well as during the activities taking place before the elections, personal data regarding the political views of the citizens, which are considered sensitive data, are processed. The latter require a higher level of protection.
The aim of the document is to provide guidance to all the participants in the election process with regard to their responsibilities in the processing of personal data of natural persons. In the light of Regulation (EU) 2016/679, the respective roles and commitments of the various participants in the election process are explained, which is essential for the proper understanding and compliance with the requirements for personal data protection.
