Identity abuse exists, when a person uses the identity of another real existing person (name and date of birth) using a document certifying identity and / or status issued to another person. In those cases, with the aim of protecting a person found to have his/her identity abused and an alert has been entered for in SIS, besides data on person`s name, special features, first letter of middle name, date and place of birth, sex and citizenship, SIRENE Bureau process also additional data.Additional data includes photos, fingerprints and ID documents number and date of issue.This additional data is processed with the express consent of individuals whose identity is abused, and it is used solely for the purpose as follows:
1. to enable the competent authorities to distinguish between the person whose identity has been abused, and the person who is subject to alert and has used stolen identity;
2. to enable the person whose identity has been abused to prove his/her identity and prove that his/her identity has been abused.
If you are within the Schengen area and know you are subject to personal data abuse you should contact the nearest police office.Therein you must provide information about your ID documents and if permitted by the national law – fingerprints and photographs.
In such a case of submitting a request to the SIS database there is a special mechanism that directs the National SIRENE Bureau to confirm whether the data of the inspected person is his/her real data, or the person has become a victim of identity theft.
If you are on the territory of the Schengen area and you find out that your rights have been affected by personal data abuse, you have to contact the nearest police station. There you have to present information concerning you identity documents and if the national law allows so – finger prints and photos.
In this case of inquiry to the SIS database an explicit mechanism exists, which redirects to the national SIRENE bureau for verification whether the individual’s data are his/her real data or that person has become a victim of identity theft.
