By its judgment in Case C-311/18 (Data Protection Commissioner v Facebook Ireland Limited and Maximillian Schrems), the Court of Justice declared invalid Commission’s Implementing Decision (EU) 2016/1250 of 12 July 2016 pursuant to Directive 95/46/EC of the European Parliament and of the Council on the adequacy of the protection provided by the EU-U.S. Privacy Shield (without its extension), as the US law assessed by the Court does not provide a level of protection which is inherently equivalent to that in the EU. The decision of the Court is valid from now on, as of its enactment date – 16.07.2020.
