The Customs Information System Supervision Coordination Group (“CIS SCG”) is set up by Regulation (EC) No 766/2008 to ensure a coordinated supervision in the area of personal data protection of the CIS information system. The CIS SCG consists of representatives of the National Supervisory Authorities of the Member States responsible for data protection and the European Data Protection Supervisor.
They usually meet once a year, back-to-back with the Customs Joint Supervisory Authority (`Customs JSA`). In order to foster good cooperation with the Customs JSA, its Chair is usually also elected as the Chair of the CIS supervision coordination group.
The Customs Information System (“CIS”) is a computer system centralizing customs information aiming at preventing, investigating and prosecuting breaches of Community customs or agricultural legislation. The CIS is composed of a central database accessible through terminals in each Member State. The data entered in the CIS relate to goods, means of transport, businesses and people associated to such breaches. The Customs files identification database/Fichier d`Identification des Dossiers d`Enquêtes Douanières (‘FIDE’) is an EU-wide index used in the context of the CIS. It is composed of investigation records, generated by Member States` customs and other investigation authorities for administrative purposes and for purposes of criminal investigations and prosecutions in the customs area.
The CIS and the FIDE are regulated under a double legal basis: Council Regulation (EC) No 515/97, as last amended by Regulation (EU) No 2015/1525, and Council Decision 2009/917/JHA (“the CIS legal framework”).
Individuals whose data are in the CIS have the right of access and the right to correct inaccurate data and deletion of unlawfully stored data. These rights can be exercised by submitting a request to a competent authority or to a data protection authority in each EU Member State. The CIS SCG has adopted a Guide for exercising the right of access, which provides detailed information on data subjects’ rights under the CIS legal framework.
On 5 October 2023, a representative of the Commission for Personal Data Protection was elected as Chair of the CIS Supervision Coordination Group for a two-year term.
