On July 13, 2010, Veneta Shopova, the Chairwoman of the Commission for Personal Data Protection participated in a working meeting at the Ministry of Justice, held at the invitation of Deputy Minister Janeta Petrova. Mr. Atanas Georgiev, acting director of the Registry Agency, register judges and representatives of Siemens EOOD also took part into the meeting.
The participants discussed the necessity of harmonization of the publicity requirements of the Law for the Commercial Register with the Law for Protection of Personal Data to ensure the privacy of citizens.
There are numerous complaints in the practice of CPDP and the Registry Agency from citizens for publication in the Commercial Register of related to them personal data such as personal identification number, number of identity document, home address, etc. Publication in the Commercial Registry of personal data of a certain category of persons is implementation of a statutory requirement under the Law on Commercial Register. The requirement establishes the public character of the Register and the right of every citizen to have free access to it and to the electronic image of the documents on which are made entries, deletions and announcements as well as the company`s documents of re-registered traders.
The possibility of legislative amendments in the Law of Commercial Register in order to comply with its provisions with the purposes and principles of the Law for Protection of Personal Data was discussed.
