At its regular meeting held on 03.08.2017, the Commission for Personal Data Protection, examined the request of electronic media and also the received signals from citizens about the practice of „Blizoo Media and Broadband“EAD to require personal ID number of end users of digital/cable TV who wish to refuse TV services.
The Commission`s opinion is as follows:
„The requirement of „Blizoo Media and Broadband“ EAD, owned by the “Mobiltel“ EAD, for sending SMS, containing information on the personal identification number of the end user, as a condition for a valid waiver of providing a service, appears excessive and contrary to general conditions for granting "Digital TV" and general conditions for the transmission of radio and television programs via a cable network. That requirement is contrary to the principles of lawfulness, proportionality and appropriateness in the processing of personal data and the law requirement that personal data must be proportionate to the purposes for which they are being processed and not exceeding their scope, introduced with the provisions of Art. 2 of the Law for Protection of Personal Data.
In order to protect the rights of large numbers of individuals – end users of the above-described service, the data controllers „Blizoo Media and Broadband“ EAD and „Mobiltel“ EAD should immediately cease the practice in question. In case of default, the Commission for Personal Data Protection will take appropriate measures against the controllers provided in Art. 38 of the Law for Protection of Personal Data.“
